Terms of Use - VocabPilot

These Terms of Use (“Terms”) govern your access to and use of the VocabPilot mobile application and related services (collectively, the “Service”). By creating an account, accessing, or using the Service, you agree to these Terms.
If you do not agree to these Terms, do not use the Service.
1. Eligibility and Account
- You must be at least 16 years old to use the Service.
- Account creation is optional. You may use the Service as a guest without creating an account.
- If you use the Service as a guest, your progress and User Content are stored only on the device and are not backed up to our servers. If you uninstall the app, clear the app data, or remove the device storage without first creating an account, your guest progress will be permanently lost.
- Certain features (for example, syncing progress across devices, cloud backup, or account-specific settings) require an account (Firebase Authentication). To preserve progress across devices or after an uninstall, create and sign in to an account.
- If you create an account, you are responsible for maintaining the confidentiality of your account credentials and for activity under your account.
- You agree to provide accurate account information and keep it up to date.
2. Educational Purpose and No Professional Advice
- VocabPilot is an educational language-learning tool.
- Definitions, examples, pronunciations, transcripts, and AI-generated feedback are provided for learning support only.
- We do not guarantee that generated content is always complete, accurate, or suitable for every context.
- You are responsible for how you use learning suggestions and outputs.
3. License to Use the Service
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial learning purposes.
You may not:
- copy, modify, distribute, sell, or lease any part of the Service except as permitted by law
- reverse engineer, decompile, or attempt to extract source code, except where applicable law permits
- use the Service in a way that interferes with security, stability, or normal operation
4. Acceptable Use
You agree not to use the Service to:
- violate applicable laws or regulations
- submit unlawful, abusive, hateful, harassing, defamatory, or infringing content
- impersonate any person or entity or misrepresent affiliation
- attempt unauthorized access to systems, accounts, or data
- upload malware, malicious code, or harmful payloads
- abuse APIs, automated scripts, or workflows in a way that degrades the Service
We may investigate and take action, including suspension or termination, for violations.
5. User Content and Audio Submissions
- You may submit content such as saved words, notes, and pronunciation recordings (“User Content”).
- You retain ownership of your User Content.
- You grant us a limited license to host, process, transmit, and analyze User Content solely to operate, maintain, and improve the Service.
- When you submit pronunciation audio for analysis, processing may involve third-party STT/TTS and AI providers as described in our Privacy Policy.
- You are responsible for ensuring you have rights to submit any content you provide.
6. AI-Generated Content Disclaimer
- Some features use machine-generated outputs (for example: definitions, usage notes, sentence suggestions, pronunciation feedback, and analysis).
- AI outputs can be incorrect, incomplete, biased, or outdated.
- You should review outputs critically and use independent judgment.
- We may update or change providers, models, and generation behavior without notice.
YouTube Terms
When you view or play YouTube content through the Service, you also agree to:
We do not control third-party services and are not responsible for their availability, content, or practices.
8. Intellectual Property
- The Service, including app design, branding, software, and non-user content, is owned by VocabPilot or its licensors and is protected by applicable intellectual property laws.
- “VocabPilot” name, logos, and related marks may not be used without prior written permission.
9. Privacy
Our data handling practices are described in our Privacy Policy:
By using the Service, you acknowledge that your information will be handled in accordance with the Privacy Policy.
10. Availability, Changes, and Feature Updates
- We may modify, suspend, or discontinue any part of the Service at any time.
- We may add, remove, or change features, including AI, media, pronunciation, and practice workflows.
- We do not guarantee uninterrupted or error-free operation.
11. Suspension and Termination
We may suspend or terminate your access if:
- you violate these Terms
- we reasonably believe your use creates risk or harm to users, third parties, or the Service
- required by law or regulatory request
You may stop using the Service at any time. You may request permanent account deletion through the in-app settings flow (Settings -> Delete Account), subject to applicable retention and backup constraints described in the Privacy Policy.
12. Disclaimers
To the maximum extent permitted by law, the Service is provided “as is” and “as available” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that:
- the Service will always be available, secure, or error-free
- outputs (including AI-generated feedback) will be accurate or reliable for every use case
- defects will always be corrected on any particular timeline
13. Limitation of Liability
To the maximum extent permitted by law, VocabPilot and its affiliates, officers, employees, partners, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of data, profits, goodwill, or business interruption, arising out of or related to your use of or inability to use the Service.
Where liability cannot be excluded, it will be limited to the minimum amount required by applicable law.
14. Indemnification
You agree to defend, indemnify, and hold harmless VocabPilot and its affiliates from claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from:
- your use or misuse of the Service
- your User Content
- your breach of these Terms
- your violation of applicable law or third-party rights
15. Changes to These Terms
- We may update these Terms from time to time.
- Updated terms will be posted in the app and/or at the hosted Terms URL, with a revised effective date.
- Your continued use of the Service after changes become effective means you accept the updated Terms.
